Terms and Conditions

 

Definitions

  1. “You” refers to the parent, guardian or person responsible for payment.

  2. “We” refers to Parker Academics, LLC and its executive members.

  3. “Us” refers to Parker Academics, LLC and its executive members.

  4. “Session” is defined as an in-person tutoring session, Skype tutoring session or class.

  5. “Tutor” is defined as an individual conducted a one-on-one tutoring session or who is teaching a class of more than one student.

  6. “Student” refers to the person to whom services are being provided

  7. “Services” refers to sessions and other academic services agreed to be provided to student.

     

Scheduling

  • Your tutor will call you to introduce him or herself, and to set up the first session at a convenient time for both of you. The tutor will also give you his or her contact information over the phone and a confirmation of the first session.

  • All sessions and cancellations should be coordinated directly between you and your tutor.

  • The minimum session length is one hour, even if the duration is less than one hour.For test prep, we recommend two-hour sessions.

  • There must be an adult home at all times. Tutors are not allowed to stay home alone with students under the age of 18.

  • We highly recommend setting up a regular weekly schedule with your tutor.


Billing & Payments

  • All billing is handled through the office. If you have a question regarding billing, or need to update your payment information, please contact the office directly (rather than your tutor).We process all credit and debit card payments through Quickbooks.After your payments have been processed, you will receive an invoice via email.Please make sure that all your billing and contact information remain updated and on file.

  • Payment will be automatically deducted on the first and 15th of every month, until the entire balance for tutoring hours and packages has been received.

  • If you choose to pay by check, your payments are also due on the 1st and 15th of each month.You are to pay the amount indicated on your invoice statement.

  • Please note that you will incur a $35 late fee for past due payments and a $25 service fee for any returned checks. 

  • Tutors are happy to stay with you an extra five minutes to debrief about the session at no additional charge.


Refunds

  • Any unused hours for tutoring packages are non-refundable; however, hours can be used at any time and are transferable to family and friends.

  • If you are dissatisfied with the quality of an individual tutoring session, you will not be billed for that session.If that session is a part of a pre-paid package, you will be refunded for the full amount.Call the office directly if you are dissatisfied with a session and we will work diligently to ensure that all subsequent sessions meet your expectations and are maximally beneficial for the student.


Cancellation

  • Please contact your tutor directly about any cancellation or schedule changes.

  • We ask that you kindly notify your tutor 24 hours in advance of a cancellation.If you cancel within this period, you will be billed for the entire session.

  • If an adult is not present when the tutor arrives, the tutor will wait for twenty minutes and attempt to reach you by phone. After twenty minutes, the session will be considered a “no show” and charged as a full session.

  • We know that your time is valuable. Should your tutor cancel the same day, or end a session prematurely, you will not be billed for that session.

  • Please contact the office if you would like to suspend tutoring services, or if you would like to discuss your tutor.

     

Non-Competition

You acknowledge that you are soliciting the services of Parker Academics for the sole purpose of academic services and not at the request of or for the benefit of another tutoring company, academic services company or competitor.

 

Intellectual Property

All Parker Academics proprietary material is protected by copyright law. Without Parker Academics’ authorization, students and parents are strictly prohibited from downloading, recording, duplicating or reproducing any Content in any manner or medium under any circumstances. If a student or parent is found to be in violation, the student or parent will be subject to disciplinary and legal action, including but not limited to any or all of the following:

 

  • Possibility of civil penalties and criminal prosecution. Willful Infringement of copyrighted works may result in federal imprisonment of up to five years and $250,000 in fines.

  • Termination of all future sessions.

  • Forfeiture of fees paid and any refund due for any unused portion of the session package(s)

  • Excluded from enrolling in any future Parker Academics’ sessions

 

Linked Websites

As a convenience to our website users, we may provide links to third-party websites. We do not endorse, sponsor, control, or otherwise accept responsibility for this material.
 
Third-party websites are not covered by our Terms and Conditions; we cannot, therefore, be responsible for the content or practices of these websites.

 

Changes to Our Policies

Our Terms and Conditions policies are intended to provide you with the safest and most secure experience possible. Since the company will continue to evolve to provide more services and technologies, we reserve the right to change, alter, add or remove portions of our Policy at any time without prior notice. For further clarification or questions about our policies please feel free to e-mail us at info@parkeracademics.com. All changes to Parker Academics’ company policies will be indicated on this page.

 

Miscellaneous

  • I agree to pay the entire amount due to Parker Academics, LLC by the specified or mutually agreed upon due dates each month.

  • I will never contract with tutors separately for tutoring services, as this action is a violation of Parker Academics’ terms of service.

  • I understand that all pay for tutoring services must be made to Parker Academics, LLC, and not to the tutors themselves.

  • An adult will be at the tutoring location for the entire duration of the tutoring session.

  • You acknowledge that Parker Academics, LLC does not guarantee acceptance to any particular institution of higher education and does not promise any particular scores on any standardized tests, academic assignments, and if applicable, business related applications.

 

Privacy Policy


This privacy policy explains how Parker Academics uses, shares and protects personal information that we collect.

 

Gathering of Information

We gather information that you voluntarily provide to Parker Academics.  This information includes: name, postal address, e-mail address, educational background, educational goals and interests, and credit and debit card information, and checking account information (if relevant).  We collect information through your submission of payment information, the website inquiry form, emailed inquiry forms and telephone conversation.

 

Use of Your Personal Data

We may use your personal data in one or more of the following ways:

 

  • To fulfill your requests for all services offered through Parker Academics or to respond to specific questions/inquiries that you may have.

  • To customize the tutoring/teaching experience to fit student needs and accommodate parent needs/requests

  • To offer you support or otherwise improve our own business practices

  • To send you information regarding Parker Academics activities, policies, etc.

 

Disclosure of Your Personal Data

We do not voluntarily disclose your personal data to third parties for marketing purposes. We may, however, disclose your Personal Data in response to legal process, to protect our rights, as otherwise required by law, or for the prevention or detection of a crime. We may share your Personal Data with trusted third parties who are delivering services to Parker Academics. We may also disclose anonymous data with third parties. We may also share your information with third parties that you have specifically designated as authorized to receive information from us.

 

If a third party paid for your tutoring sessions, then that third party may request access to academic records.  By signing this agreement, you would be authorizing Parker Academics to disclose academic records to that third party, or third party representative. 

 

Security & Information Retention

Parker Academics employs security measures to protect your information both online and offline from access by unauthorized persons and against unlawful processing, accidental loss, destruction and damage.

 

Arbitration & Class/Collective Action Waiver
Any and all disputes arising from or related to this Agreement, other than disputes relating to intellectual property infringement, including whether the dispute is arbitrable and the scope of this arbitration agreement, shall be finally resolved by arbitration administered by a single arbitrator under the then-applicable rules of the American Arbitration Association in accordance with the Federal Arbitration Act. The arbitration shall be governed by and construed by federal law to the fullest extent possible. Unless otherwise agreed by the parties, the arbitration shall take place in the largest city within 100 miles of your permanent residence. Judgment on the arbitral award may be entered in any court having jurisdiction thereof.

 

To the maximum extent permitted by law, should you wish to initiate a legal action against Parker Academics, LLC, you waive any right or ability to be a class or collective action representative or to otherwise participate in any putative or certified class, collective or multi-party action or proceeding based on such a claim in which Parker Academics or a related entity is a party. The same applies to Parker Academics’ legal actions against you. Thus, you and Parker Academics agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class. Further, unless both you and Parker Academics agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over a representative or class proceeding.

 

Consent and Release

  • Parker Academics reserves the right to contact you regarding the progress of sessions.We may ask for any feedback that we judge will enhance the overall quality of our company and the learning experience of its students.

  • Sessions may occur in "Third Party Facilities" not controlled by Parker Academics. As such, you waive any claim against Parker Academics arising from your (or your child's) use of Third Party Facilities, including claims related to the safety and security of third party facilities.
